Help with MN1 Application

Help with MN1 Application

Dear Forum Members/Experts,

I am once again looking for your valuable advice in getting the MN1 application for my daughter in place.

My daughter was born in June-16 and at that time neither my wife nor I had the ILR. I have now acquired ILR in October 2017 (my wife is still on Tier 2 Dependant) so, I assume I am able to register my little one as a British Citizen as per section 1(3) which states

“Section 1(3) - A child born in the UK whose parents are not British citizens and were not settled in the UK will have an entitlement to register when one of their parents become settled in the UK or become British citizens.”

Also, since her birth, we never travelled anywhere outside the UK so never got her an Indian Passport.

My questions are:

1) Whether or not I can register my daughter as British citizen?
2) Is section 1(3) correct?
3) Part 1.2 & 1.3 of the MN1 form are not to be filled as we do not have any reference number and the Child was never granted ILR earlier.
4) Part 1.9 – Child’s Nationality – Shall I mentioned Indian or leave it blank? In principle – she does not have any nationality at present.
5) Part 1.36 – Shall I leave it blank as my wife does not have ILR status at present?
6) Section 2, part 2.1 Date of first arrival – What date needs to be given here – Child’s birth date? She’s never travelled outside UK and does not have any passport at present.
7) Last 5 years Address for the Child – She is only 1 Year and 4 months so, no other address history.
8 ) Section 3, Part 3.3 and 3.5 – Do we need to provide parent’s absence details here within the last 3 years?
9) With regards to the ceremony - The child is too young for that. She hasn’t started speaking properly yet. Does she still have to attend the ceremony?

So, I take the only documents we will have to provide is:
Full Birth Certificate
Parent’s Marriage Certificate
Father’s ILR status letter + copy of BRP
Fee (cheque) - £973

Any other document that I am missing on?

1. Yes you can.

2. Yes it is.

3. Leave blank

4. Not sure, there has been some debate on the forum regarding this. Did you register her birth with the Indian authorities? If yes, then she is Indian.

5. Leave blank as she does not have ILR.

6. State date of birth.

7. So write address since date of birth.

8. Leave blank, not relevant to you.

9. The ceremony is ONLY for applicants 18 and older and NOT for children.

Thank you for replying to the questions.

We never registered her birth with the Indian authorities. Would you be able to share the link of the discussions within the forum regarding this? I am so confused what to mention there.

Also, document wise are we okay? Am i missing anything?

It is not one specific link just members posting in many topics about it.

Documents are fine. You don't need ILR letter (it doesnt say you have ILR). BRP and your passport is fine.

Apply using NCS at the council and apply MN1 and passport at the same time and you will get to keep ALL your original documents.
