Spouse visa after appeal allowed

Post by Stevie42 » Wed Oct 25, 2017 6:18 pm

Hi I’d like some advice regarding my wife’s situation if possible. A brief summary is as follows:

My wife applied for her spouse visa on 18.03.2016. Her application was refused on 15.04.2016 with the ECO stating that I had not provided enough evidence to meet the financial requirements, they were suspicious as to why I had no family attend the wedding and she was also accused of falsifying a greetings card.

We then appealed the decision, submitting grounds for appeal and various documents to back up our appeal, however the ECM maintained that the decision was correct.

The case then went to immigration court on 25.07.2017 where I produced almost 3000 pages of evidence, consisting of my payslips for the past 2 years, p60s, letters from my employers, what’s app transcripts, telephone logs, tickets from my travel to stay with my wife, a receipt from an online company proving my wife didn’t falsify her card and a witness statement from my mother detailing why she couldn’t attend our wedding.

On 27.07.2017 our appeal was allowed by the immigration judge and determination was sent out.

On 26.09.2017 my wife received an email stating that an ECM had reviewed our case and she was requested to submit her passport to the visa application centre where the application was originally lodged.

On 29.09.2017 she submitted the requested documents and since then we have heard nothing. Obviously we are more than a little concerned as to what is going on. Any advice anyone could give me would be much appreciated.

Did you have your IHS payment refunded after your visa was refused ??

Have you been asked to make the IHS payment after appeal was allowed or after you were asked to make the submit the passport.

Getting your visa can take few weeks but this could be the reason for delay if you still haven't received the passport after nearly 4 weeks.

Trying asking them for a link to pay either through email where you were asked to submit the passport or through UKVI contact center

This is my understanding, maybe more senior members can advise better.

Good Luck
Biometrics Karachi 04/08/17
Decision received 11/10 (Visa refused on subsisting relationship)
Acknowledgment 18/12/17
Deadline 02/04/18
Decision withdrawn 26/02/18
Decision overturned 29/03/18
PP submitted 3/4/18
Visa granted 9/4/18

I’m not sure, I believe it was refunded when her application was originally refused. That said, surely they should have asked her to pay it again when she submitted her passport.
