Hi all, hope you are well. I am in the process of applying for my ILR via UK Ancestry. I was under the impression (after extensive research) that my wife is eligible to apply with when I become eligible to apply for ILR irrespective of how long she has been in the country. However, I have just been given some disconcerting information that this might not be true.
I entered the UK in December 2012 on a UK Ancestry visa. My 5 year requirement for ILR is up in December 2017. Bearing this in mind, we decided to apply November for our ILR. My wife entered the UK on a UK Ancestry Dependent visa January 2017.
I am unable to find anywhere which states that there is there any minimum requirement for how long my wife has been in the UK to apply for ILR with me. I have reached the 5 years, but my wife has not.
I have been told by numerous people (consultants and home office reps) that she has to complete 5 years before having to apply for ILR, however, no where can i see that written anywhere. I believe the 5 year requirement doesn't apply to ancestry.
I have checked and there is no way to apply for an extension of the UK Ancestry Dependent visa if the main applicant is not applying for an extension.
Hoping there is someone here who has either been through something similar or has any experience.
Urgent help is greatly appreciated.
