Tier 1 Entrepreneur Visa Conditions

Post by Ali272 » Wed Nov 08, 2017 12:30 pm

Hello,

May I ask what are the conditions we should stick to beside registering within 6 months of entry, working for our own company only, filings all HMRC & Companies House documents properly and on time and always keeping and maintaining access to £50k we originally invested into the company.

I am on Tier 1 Entrepreneur granted last November and I'm hearing many people are put on hold by HO so they can check if they kept to their Tier 1 E visa conditions. I'm exactly a year from ILR (LR) and I'm anxious so I want to make sure I 'm very careful and I stick to all Tier 1 E conditions so there won't be any problem.

Thank you very much.

Thank you Zimba.

Yes, I have. I'm aware of no recourse to public funds, police registration, etc but these conditions do not require a bank statement and I read on the ILR forum they were asking for bank statements? I mean on the business side, What does HO look at? For what business reasons can they reject a 10 year ILR application?
Can they for example simply reject our 10 year application because of Tier 1 genuineness test? I'm not sure if Genuineness test is part of conditions of stay, I think it is only part of extension and 5 year ILR? I'm just so worried and want to clarify things. (I have been always worried about genuineness test even after my application was approved because genuineness test is so vague).

Thank you very much.

Please follow the guide and ignore individual cases on the forum. HO will ask for any extra documents if necessary.
The rules give HO the flexibility to reject your ILR for all sort of reasons, including the concerns regarding your genuineness.

Ok thank you Zimba.

Just one more question, Has there been any case of 10 year ILR that you are aware of that was refused due to Tier 1 entrepreneur business/genuineness reasons?

Thank you so much.

No, I have not heard such cases. There have been only few cases of refusal based on the genuineness
