Name on Housing register (Tier one dependent ) - Impact on Visa extention

Post by Darly » Wed Nov 15, 2017 7:36 am

Hello Everyone, please help me

I am a British citizen with two children (one British and one Tier one general dependent) and wife tier one dependent. They will be eligible for ILR in February 2019, but I need another extension for them. I had to register myself on the council housing register with family due to medical needs of my non-British child. My application is also supported by medical professionals working with my child. Initially I applied it on my name with three dependents, however local authority has changed it to Mr And Mrs.
Further I requested that please consider my application under section 17 Children Act 1989 (https://www.legislation.gov.uk/ukpga/1989/41/section/17) and awarded accordingly which states
" A child in need, or their parent, carer or guardian, where a local authority is under a duty to provide support under the Children Act 1989 (England), Social Services and Wellbeing (Wales) Act 2014, Children (Scotland) Act 1995 or the Children (Northern Ireland) Order 1995 ".
I haven’t received any response yet.
I had no intention to claim a house and probably will not get it before 2019 if not granted under section 17 Children Act 1989.

I want to apply for an extension of tier one general for my wife and son now.
Does the above will have any impact on their application?
Just being on housing register mean claiming benefits?
Do I need to mention this on visa application under claiming benefits
?
I meet the financial criteria for an extension.

Thanks

Put your details on LHA Bedroom calculator. Only put the details of British family members. You will see how many bedrooms you can get without adding the family members who do not have recourse to public funds.
If you get more than that then you will be breaching the immigration conditions of Tier1 Dependant visa.

Thank you very much for the comment. Unfortunately local authority would not agree to that and they put the names of all my dependents. Also morally it would be wrong not to mention who would be living there? I haven't claimed anything yet I am just on housing register on medical grounds
