Am I eligible for ILR?

Am I eligible for ILR?

Hello,
My partner has ILR since Jan 2017 through the 5-year TIer 2 route and I am on PBS dependant visa since December 2013. Before that I was on Tier 2 visa myself.

We have been living together in the UK since 9 years.

The Gov.uk website states the following:
You must also have been living with your partner in the UK for at least:
- 2 years if you applied for your current visa before 9 July 2012
- 5 years if you applied for your current visa on or after 9 July 2012


I applied as a dependant for the first time in December 2013 and then renewed it June 2015. Therefore, the second point applies to me.

However, because I having been living with my partner for 5 years, therefore I should be eligible for ILR, right?

I have spent the last 5 years living with my partner on Tier 2 visa till 2013, and then PBS dependant visa.

Any help would be much appreciated! Thanks!

No. You need 5 years of PBS dependent visa to be eligible under this route for ILR. Time spent under Tier 2 will not count. You will be eligible by the end of next year.
