I am seeking advice on whether I can apply for my newborn son's UK visa from my home country of Australia rather than from within the UK, and what kind of processing time to expect if I can.
I entered the UK on an ancestry visa in October 2014 and my son's father is a dependent on my visa. All three of us are Australian citizens with no other nationality. I can apply for ILR in September 2019.
My son was born in August 2017 in the UK. I would like to get him a visa so he can travel outside the UK. From within the UK, I can apply for him to have a visa using form FLR(IR) (https://www.gov.uk/ancestry-visa/family-members). I've been told by UKVI that the application would take around 8 weeks to process.
I would like to travel with him to Australia during my limited maternity leave so would prefer to apply for his visa from Australia. Would the application be treated any less favourably if made from outside the UK? We would only be able to stay in Australia for a few weeks so the processing time matters. Would it be considered an application for a settlement visa, which has a longer processing time? (https://www.gov.uk/government/organisat ... r-services).
