cooling-off period Tier2 visas

Post by ajsaggi » Wed Nov 29, 2017 10:36 am

Hi, My wife had a Tier 2 long-term ICT for few years while I was a PBS dependant here in the UK. Then I got my own Tier2 general sponsorship from my UK employer, AND, my wife became a dependant on my tier2 general visa. The switch-process was hassle-free though I did have to travel to India for stamping purposes.

My query is whether the cooling-off policy still applies to my wife's immigration status and how? Is she now allowed to switch to a Tier2 general main applicant visa if her company agrees to sponsor?

cheers
A

How long ago did she switch to Tier 2 General Dependent?

It is always helpful if you post all the actual visa start and expiry dates

If she has been on the PBS Dependent visa for 12 months or more, she has passed the 12 month cooling off period requirement and can apply for a Tier 2 General visa from home country if she meets all the requirements.
