ILR SET(M) Section 3 - Do I need to include information about my 1 year old son who is a British citizen?

Hi,

My husband and 1 year old son are both British nationals with passports, and I am applying for ILR next Friday. I am confused about whether I need to include information about our son in section 3 of the application form, because the wording is vague. It says, "You are required to provide details of any children under 18 who are living with you in the UK, and who are applying for indefinite leave to remain as your dependants."

I am confused about the word "and" - does it mean that we need to include a child that is living with us, and include a child who is applying for ILR? Or does it mean that we only need to include information about our child if he's both living with us and applying for ILR?

I also read in the SET(M) guidance that we need to bring any dependants with us to the Croydon Premium Application Centre on the day of our appointment. Do we need to bring our son along if we're not applying for a visa for him?

Thank you in advance! Very stressed about this...

Unless you think that the "," prior to the "and" is an implicit "or", then you don't need to include British child in Section 3. However, there may be other Sections in the form that applies.

Thank you Vinny. It does give space in question 3.9 to elaborate, so I think we will declare the child there.

Any idea about whether I need to bring him to the appointment this week?

Only the applicant(s) are required to attend the appointment. They can accompany you as a guest though, no problem in that.

Hi Emcmurrin,

I'm going through the same thing at the moment with my 6 month old and need to apply in December. Was also confused by this as my husband and son are both citizens. Did you tick any boxes in section 3 and fill out the child information? Or did you just elaborate in section 3.9?

Any advise is appropriated! Hope all went well with your application and successful.

Hi Guys,

I recently applied for my ILR using online form submission. The beauty of online form is, it trims off everything that isn't applicable to your case. I have 2 British born children. Based on my inputs, it did not ask any additional questions around my children as they are not subject to immigration. The checklist towards the end did not specify anything for my children so I did not send any documents pertaining to them.

I did the same during my previous visa extension a couple of years ago, no issues.
