Thanks Marcnath.
Still no reply from them. It has been totally 48 days after my submission.
lastly on 6th-Jan I send the requested business plan but still no reply at all.

I have asked my AR status to the helpline ( outside Uk contact email -paid one) and got this below reply.
Is this standard reply or it is kind of a positive note as they said I will get a invite to submit my passport.
For the paid enquries they reply like that ( after 1 day) but I have send the requested information also but further no reply on this.

Please advice your thoughts. Thanks.

Please don't waste time and money on calling/emailing the contact center for the administrative review status. I did spent few times and finally got this reply. Thanks.

Dear ***,

Thank you for contacting UK Visas and Immigration International Contact Centre.

With regards to your enquiry, unfortunately for the administrative review we are unable to track the status of this, you will be notified once this process has been completed as the decision making centre will take the necessary time to process this.

Hello Marcnath and few other Experts,
Please share your thoughts and ideas for my next step.

Unfortunately my AR is not success and find the email attached below.

your application is refused under 245DB (f) (g) of the Immigration Rules.( Previous Refusal reason)

Please answer my questions:
The first refusal got 5 reasons and ECM comments about 3 reasons so it means he removed the others 2 reasons. The AR says Genuineness: Meets the requirements of Paragraph 245 DB (f) of the Immigration Rules. It means they have remove 245DB(f) also from my refusal and hold the refusal only under 245db(g)
Am I correct..??

Please share your ideas for my next plan.

The plan what I have in my mind as below and advice me.
1.My partner already registered the proposed company in his name and can I join as a shareholder & director to strong my case to prove that I am genuinely interested in making business.
2.Change my business plan to cover the refusal reasons.
3.Get the premises rented out and share the pictures in my fresh applications.
4.Do you think make a trip to UK in between will be helpful to show a market research proof..??

Please advice me as I need to do the next step soon.

Thanks for being supportive.

Administrative Review under the Points Based System (PBS)

You applied for entry clearance to the United Kingdom as a Tier 1 Entrepreneur under the Points Based System. Your application failed to meet the qualifying criteria and was refused on 16/11/2017. Your request for Administrative Review was received by this office on 11/12/2017. I am writing further to my letter dated 28/12/2017 and apologise again for any inconvenience caused.

I have reviewed your application and I am satisfied that the decision to refuse you entry clearance was correct. Details of my decision are on the back of this letter (Points Summary Document).

I have noted your statements made as part of your administrative review request. I note you state you have been working in the jewelry market for a significant period of time and that you have done appropriate market research before proposing to start your business in the UK.

I am not satisfied that the statements made in your Administrative Review request addresses the concerns of the Entry Clearance officer.

I note that you state you are fully aware of the contents of your business plan however your marketing strategy as stated in your business plan is not consistent with your Reponses at interview. You indicated you would approach senior buyers for companies but appear to have no definitive plan for doing so. I also note that you have indicated that every larger company you have approached so far has declined your services.

It is noted that you referenced online sales during your interview and in your business plan. It was unclear from your responses at interview how having a physical presence in the UK would improve your access to this market, which you already have a presence in.

You state the you found your proposed based of operation through a friend in the UK who you previously have done business with and this friend also recommended someone to help with your business plan. You have not indicated that you have done any market research about the cost of hiring alternative venues for your business in the UK and instead have relied on your friend’s recommendation. I note in your Administrative Review request you state Park Royal London was chosen due to its access links to the country and commutability. This was not the response given at interview when asked why you chose the location, you stated that “Most of the big customers have office in London the chain stores the head office. If I’m in London its easy access for the meetings”. There are numerous locations for offices in London and this answer is considered to be vague and lacking in detail.

Therefore, the grounds for refusal are maintained at review.

I don't think so. I believe you are still rejected under 245DB(f)(g). The sentence "Genuinesss: ....immigration rules" looks to be more like the subject/title.

I don't think 1, 3 or 4 will help.

That is based on a comment in the letter

If you establish a presence and a running business before getting the visa, you just strengthen the CW's case that your being physically in the UK will help (since you are obviously able to do all that without a T1E visa).

This is another problem you need to address - not sure how. If you had identified customers and had not approached them yet or if the reason for the decline was the fact that you were not here physically, those would help support your case. That might be something that can be covered in a fresh application.

Do you really need to move to the UK for business purposes ? If so, consider not just about what you will add to the UK but also what being in the UK will help you. There are clearly a number of people who use T1E purely to enter and settle in the UK and that is impacting all applications.

Good luck with your fresh application.

Thanks again for your gem of advice. You have been a big asset to this forum and always I get upgraded with myself after reading each one of your reply to any post.
I have spent XXXX with so called business plan writers and lawyers/solicitors but they are always trying to take financial advantage at their best ( no offense as it is their business). But they mostly work from their experiences of few cases that they dealt not like the contributors in this forum who have seen so many cases and their proceedings for many years.

Now I am very clear of what to do and dont in my fresh application.I hope each application will be treated on its own merits but I hope still there is a consideration of previous history.

For Tier 1 ENT ( Initial - outside UK) application is there is any limitation/restriction of days/times..?
Please advice so that I will use my chances wisely.
Thanks again.

There is no 'premiuml upgrade' version of the forum and neither is there a way to 'donate/sponsor'.

PM function will remain disabled for the time being. Post in public for advice so that all may offer advice and/or benefit. Remember, everyone on the forum is a complete stranger and we have many scammers and spammers who trawl the forum.

Post by heema » Sat Dec 29, 2018 9:31 pm

Hello,i came to uk in july 2018 and before that me and my husband had also applied for his visa after getting my visa in india, but he refused and the reason was that i and my husband having different residential address in our visa application form and so that they dont believe that we are living together. After that i came to uk and we applied for my husband again with all the proofs of uk and india as well but they again told that the notary that we put in file saying that we were living in same address when i was in india is self evidence and not legally registered ,we put all the documents need to prove a relationship of husband and wife so after that we applied for AR and got email to submit all the documents again that was in file of my husband and we sent on 20 nov 2018 and they said to wait until 28 days but i am still waiting its more than 28 days now but still waiting not get any reply.please suggest what to do.
