National Insurance deduction on ICT Tier 2 long term visa

Hi,

I arrived in UK 2 months ago on ICT tier 2 long term visa from India. I have a contract with my employer for 12- 24 months.This time period can vary depending on the project requirements.My employer has made me an employee (Not permanently) of their entity in UK. My employer is deducting National Insurance contribution every month from salary but I believe, I should be exempted from paying it for the first 52 weeks.My employer believes I am not entitled for exemption and is not giving me any explanation.Can anyone help me understand my case and if I am entitled for exemption.If yes, how can I present my case to HMRC to seek decision on my case so that I can show proof to my employer that I am exempt form paying NI.

Hi CR001,

Thanks for sharing this page.
I have gone through this a lot of times and shared this with my employer.
It says "you won't have to pay national insurance if you are sent by an employer in your home country to temporarily work in UK". Does this mean you will be exempted only if you continue to be employed by the employer of your home country and not the employee of any employer based in UK?
I am an employee of the UK wing of my company.

Hi,

We are also in same situation, my husband is employed by the uk arm of the company and we are wondering if he will be eligible for ni exemption. Last we heard from a friend is that he will. In fact the employer also is supposed to be exempted from the ni payment. So if the employer is saying that they are not aware of the rule we can ask them to appoint a tax consultant and sort it out because it's for their benefit as well given that employer contribution is quite huge.
He is also supposed to get 30% of the salary max as accomodation allowance so the amount of rent paid below this limit will be tax exempted. Earlier it was hoti 70% of the salary that was exempt for rent and other living allowances. Need to check on what is the take on the other allowances now.

Major Question remains is whether the dependent will also be able to benefit from the above 2 points.
Let me know if you get more clarity.
