FLR(FP) Partner 10 years route

Post by Trilogic » Thu Dec 14, 2017 6:59 am

Hello fellow gurus
I was granted leave to remain 10 partner route,my partner is british,we have two British children together and we still in a relationship.
We plan living separate as she is struggling financially at the moment and with me living there she doesn’t get enough support from the government (She gets paid Single claimant even tho we living together as a couple, that’s because I am entitled to no public fund, and they take my wages into consideration befor calculating what she is entitled to,she comes out with nothing)
This have been going through my mind and I hope I could get a clear answer if anyone can help.

Will it affect my extension if we are living seperate? As I will have to move my letters away from the house?

We are still in a genuine relationship, just not living together.

Thanks.

You will not qualify for an extension under FLR(FP) Partner route. You are also risking benefit fraud as I assume you will still be supporting her financially.

Thanks for the swift reply.
Is it possible to then switch to FLR(FP) as a parent as I have court order for my British son which I have direct contact with and support financially as well.
Will it affect my route to indefinitely leave to remain? That is,will the 2.5 years from been a partner be wasted?

FLR(FP) Parent route is for a parent who is NOT in a relationship with the child's other parent.

Thanks for the reply,
Casa said I won’t qualify to extend my visa as a partner.
Also thought the parent route could be an alternative,am I out of options here?
Need advise for future reference.

Thanks

It appears from your post you are trying to find a loophole to maintain your visa status, still remain in a relationship but not live with your partner etc all because your partner is not getting enough benefits due to your salary being taken into account and both of you living together.

You won't qualify for the PARTNER route if you are NOT living with your partner.

You won't qualify for the PARENT route if you are still in a relationship with your partner and the childs other parent.

Presumably you earn enough to maintain the household??

I don’t earn enough to maintain the household,I earn 1300 a month, she gets a SINGLE claim universal credit been paid to her (SINGLE) for reason I am not entitled to public fund,I plan moving in with my mum and maintain a good relationship with her, also I am not in a relationship with my ex,we have a child together which I have contact with and also have a court order with.

She should be getting 'single plus child' if there is such a thing under universal credit.
also I am not in a relationship with my ex,we have a child together which I have contact with and also have a court order with.
If what you state is true (but you live with the partner), then you don't qualify for the partner route anyway.

I won't comment further and will leave others to offer advice on how you can achieve the 'best of both worlds' as that is how it is coming across.

Hi mate your trying to find a loophole to make things work out for you financially but your missing the point from our two most senior moderators that it'll be consider a deception and cost you a bombshell amount of money if anything goes wrong during your extension, trust me UKVI is not naive they can find any discrepancies in your further leave to remain and use that as a sole excuse to won't extend your visa.

I would suggest you to contact immigration advisor in this case as I don't think nobody will give you any lame suggestion on this forum to extend stay while not living together or go through parent/partner route though one or the other won't apply in your case anyway.
