REALLY COMPLICATED SITUATION/CASE!

Post by FaisalFahim » Fri Jul 21, 2017 1:37 am

Hi there, I've been having some serious problem with my situation to stay in the country and I really do not know what to do. I have a very complicated and lengthy case due to this reason I'll try and make it as simple and easy as possible for you guys to read. I really need some support/ help / advice I am tired of going to lawyers and people who seem heartless and don't give you hope or proper advice so I decided to try this. Here goes nothing...

Facts :
1) I came to the country from Bangladesh at the age of 13 in 2009 with my mother and younger brother (2 years old at the time now 9 years old) and met my father (who was already living in the uk).
2) I was on my family's political asylum claim as a dependant and every case got refused since 2009.
3) I went from being dependant on father's family joint political asylum claim to becoming dependant on mother's asylum claim because my parents separated and father left.
4) when I turned 19 my mother's case was also refused and I was removed from their case by home office due to me becoming an adult and etc.
5) I met my fiancé in 2014 and we have been together till now. we have been engaged for 2 years and living together NEARLY two years still got good few months to go.
6) I applied my own FLR(O) case in 2016 after I was removed from mums claim but it got refused because I had no passport /ID. my lawyers at the time said it would all be okay but clearly not
7) I then applied asylum because I didn't no what else to do or go for.
8.) my asylum interview happened beginning of 2017 and I went all in with my family life and my father being abusive and article 8 and partner and me coming in as a child and cannot relocate because father is abusive and I think he is in Bangladesh and I am scared of him and do not want to leave child hood friends from here and etc.
9) home office refused me and now I am applying for appeal (oral hearing)
10) I went school and college here did a levels and volunteered for charity groups don't have NI number or anything .
11) I am 21 years old now. my partner is working full time earning well above 18k+ we live in a rented house by her she pays for everything she has a god job and career and ambitions. she is full white British.
12) my mother and brother are going through their own flr(fp) application (no decision yet) and brother has learning difficulty.

I do not have any kids and I have actually got a legit relationship and I do not know much about my country since I came as a child. I tried every document I could think of to use as proof for my case just in general witness satements pictures Facebook convos receipts certificates and etc etc etc.

what is my best chance in oral hearing? what should I do please someone guide me as much as possible? I have done all the applications etc etc by myself. anyways wants to pm me to see my full detailed documentation of the case feel free!

CASE ALLOWED BUT HO APPEALED IT AND GOT REFUSED

Post by FaisalFahim » Thu Dec 14, 2017 5:28 pm

Hi recently the my asylum case went to first tier tribunal and the judge allowed the appeal under article 8. HO them appealed and wanted permision to take it to upper tribunal. A different judge from first tier tribunal reviewed it and said that the home office are incorrect and there has been no error of law and they are appealing simply due to the fact that they disagree with my case being allowed and accepted. What will happen now? HO can appeal directly to the upper tribunal but they have no merit against my case? Will they do it or what is the % chance of that happening? I called the court and they said HO have 14 calender days to appeal if they want to directly to the Upper Tribunal but anyone else been through this? My case has been allowed but the HO are being ignorant and trying to drag this on. What should I be thinking?

Case allowed in first tier tribunal

Post by FaisalFahim » Mon Feb 26, 2018 5:27 am

Thanks to God and all my hardwork and my partners hard work my asylum case has been allowed under human rights. I'm 22 years old and fought my case since I was 19 by myself and I have won. Now since December 2017 (when final decision was made for my case to be allowed) I'm waiting for my biometric and success letter from home office. How long is the realistic wait? I've called them and contacted them still no response or updated? I'm willing to answer anyone's questions. Thanks.

That is a great news!

It can take a while, since you have won just wait for them to contact you.
