ILR As Partner of Tier 2 Holder Who Settled

Post by nkinawi1024 » Fri Jan 05, 2018 4:01 pm

Hi all,

I believe I am eligible to apply to settle in the UK as the partner of a Tier 2 holder who has settled in the UK (as my husband just recently received his ILR).

However, I'm slightly confused about the eligibility criteria, specifically the "You must have been living with your partner in the UK for at least 5 years if you applied for your current visa on or after 9 July 2012"

I did get my current visa after this date. However, how do they base the 5 years living with your partner in the UK? Is it based off your previous visas or based off documents (i.e. rental agreements)?

If it is based off visas, do any visas count towards the 5 years or only dependency visas? I originally came over on a student visa 5 years ago and was living with my husband (then boyfriend) since I moved over here. Does my time on a student visa count towards this 5 years?

Any advice would be great.

Thanks!
