Have you asked your employer about this possibility?

I really don’t think many of us have much hope next month now. Everyone will just re-apply and the amount of certificates will be even lower as we’re very close to the end of the year. They’ll want to keep some spare of genuine emergencies, skilled shortage applications, etc.

I have a few observations to make

1. The cut off last time was 55, this time someone with 55 got rejected & 50 got approved. If we take this on face value, it goes beyond just points. Further so folks with 30+ and 60+ are still awaiting results.

2. Historically the monthly allocation has never been over subscribed for back to back months. So this is really surprising! My legal attorney says this is unprecedented

3. Is there any explanation though for the sequence of result declaration. The higher scores getting approvals before is ruled out as 60+ cases are pending. what could possibly be the reasons?

4. Also clearly the difference between refusal and rejection needs to be understood. Most of applications don't meet the requirements hence even higher scores are rejected.

5. Refusal is only in case when the allocation is oversubscribed

Can you share other details about the refusal letter/e-mail

1. Does it say it was oversubscribed for Jan 2018?
2. Did you attorney say something about the cut off?
3. Is it a rejection or refusal?
4. Did you apply in December as well?

These questions will help the waiting candidates in the range 40-50 (who have not received updates, as yet) get a fair idea. As the thread has been quite confusing this time compared to December where pretty much all the high scoring candidates shares their approvals followed by low scoring candidates of their refusals.

There is no clear trend that seems to emerge out of this thread. Your response will help others in the 40-50 points range!

My guess is that they probably already know what the the points cut off is (?over 55) but they need time to go and change the status of all the others applications/inform employers, etc. I say those of us with points lower than 55+ or whatever the cut off is will receive our rejections in the next few days.

The strange occurrence is someone with 55 got rejected while someone with 50 got approved - perhaps that poster wasn’t aware that their job was on the shortage list or something. Also strange though that the poster with 50 points who’s application was rejected due to a missing form was told that 50 points was absolutely fine this month yet 55 wasn’t enough...

These observations are great, I have a few comments to share ontop -

1. I completely agree that there is much more happening in the background and points aren't everything when it comes to the verdict. However, it now seems likely that those below 50/45 will soon get some bad news. Please note that case-works in HO department work at their own speed so not everyone will receive news at the same time.
2. From what I heard, December was full of shortage-occupation and nurses in the quota and given the recent winter crisis faced by NHS and other medical institutions, nurses are being hired in bulk. Therefore, Feb and March look just as bad as the past 2 months.
3. As mentioned, case-workers operate via individual speed so we can only get an indication from those applicants that have already received some news.
4. From my experience - and previously mentioned by @sPTULA, 'rejection' implies a fault in your RLMT / application whereas 'refusals' are given if quota has been filled. Therefore, a 'refusal' is a sign that your application might not have any faults.
5. Correct.

This is the info I have learned from the past 2 applications made and refused and potential 3rd one to be refused this month.

It should be grounds for an argument but I understand that HO is overwhelmed with applications as it is, so any complaints or requests might go unnoticed. There is an appeal process but note that its a 3 month wait and watch game with no clarity of what it will result.

My only burning question is - does anyone have any news on what happens at the end of the allocation quota this April?

The guidance states that applications can only be considered outside of the monthly quota if they reached the amount of points that was the cut off as per the previous month.

As December’s cut off was 55 an application should not have been approved out of the quota with 50. My guess is that Gaurav actually had more points than they thought, or it was an error, or perhaps with the influx of applications they’ve just thrown a lot of the point system away and are granting based on type of job, importance at present, etc.

This mainly bcoz there is huge recruitment of NHS nurses and other Shortage occupation jobs appliations are flowing since last month

If our applications don’t have enough points will HO still review them and inform our employers if anything was wrong with them?

This is my first time applying and while I’m expecting to not get enough points I’m hoping HO will still review the application and notify my employer if something is wrong or missing.

@Everyone, Another point I noticed here is, People who posted that they got refusal are probably the ones who haven't got Rejection in December month, they have only applied in January and got Rejection

We need to wait to see if there is someone who git Refusal in December & January as well

Anyways, this does not mean people whoever got Refusal in December should not ger Refusal again in January, we may still get a Refusal soon this week

But I am just trying to make some analogy here

Yes, if there is something wrong with your application, then the rejection email will reach your employer's mailbox, along with the reasons for rejection (RLMT not properly conducted etc.).

If there is nothing wrong with your application and quota has been reached, then 'refusal' email is sent across.

What's your score?

I think some people (mschase might have been one?) were rejected in December + January although I might be wrong. It all starts to get confusing after a while.

I’m not 100% sure because my employer only gave a salary range (haven’t negotiated the final figure yet) although either way it will be low thirties so I’m not expecting to get it.

Does anyone know how you calculate your point score? I was rejected, but not sure what my points were. The salary was £37,500 but I can't find anywhere that explains how many points this gives me. Any help would be appreciated so I can reapply in Feb with a better understanding.

• PhD-level occupation code and job passes Residence Labor Market Test (or an exemption applies): 75 points

I think besides this, there would be a criteria under 'Occupation category'. Certain jobs carry more salary than the others. It won't be like they'd be taking all people who applied for a particular occupation in case their salary was in the highest category. They'd be selecting nurses/PhDs/Engineers etc. from each segmentation I guess. Otherwise this point system doesn't make any sense.
