Help on Passport Issue UK Spouse Visa Application

overstayer applying for UK spouse visa

Hi I am an overstayer in the UK for more than 10 years and married to a UK British National for more than 2 years now. We are planning to go back to the Philippines to make an application for UK Spouse visa. Will there be a reason that Home office will refuse our application from the Philippines If I am applying as a spouse already of UK British national? Thanks.

Help on Passport Issue UK Spouse Visa Application

Hello. Will anyone help me or advice me on what to do please.

First of all, I am applying for UK Spouse Visa. I am in the UK at the moment and planning to go back in the Philippines in April 2018. I have overstayed my visa. Now my problem is, I have acquired several passports in the time I am here in the UK.

1st passport - the first passport I used when I come to the UK which is well expired already

2nd passport - renewed my passport because the 1st has expired.

3rd passport - I apply again because I got married and want to use my new name on the passport. I used this passport to apply for Irish Visa as my husband is exercising his treaty rights. (He is British national by the way) But the processing took longer than expected so we decided to make application in the UK for Leave to remain on family and private life to the home office. I also used the same passport. Now this is whith the Home Office.

Then December last year, my Irish visa is ready for issuance. But I cant get it because my 3rd passport is with the Home office still.

4th passport - I make another application (as per advise of my solicitor) to apply for a new passport so I can try to get my Irish visa. So went to Phil Emb here and declared my 3rd passport as lost. But unfortunately my irish visa has expired on collection. So now I have 4 passports. I also use this 4th one to apply for my ielts here.

My question is, when I go home, Home office will release all my passports (3 pcs). Will this affect my application in the phils when I gave them all my passports? Mind you 3rd and 4th passport s are still valid. the same name as well.

Will this be a ground of deceiving the authority? Eventhough I will show all 4 when I lodge my application?

What is the best way to explain this to my cover letter?

As you said that you declared 3rd passport as lost to get 4th passport and now you have 3rd and 4th valid passport. How can it possible that 2 passports are still valid and 3rd one you declared as lost & you still got it. Usually no embassy/consulate issue more than one passport which remain valid & on issuance of New passport the old one become void.

Thanks Seagul. Yes, I have declared the 3rd passport as lost.

Do you have an idea if I write this on a cover letter explaining what happened, will they accept it? Will this become a ground for my UK spouse visa application?

I do not intend to lie on any documents I will submit. Maybe anyone or yourself could help me draft and reasonable and acceptable format letter for this? Thanks

HO hate lie & have no sympathy for that. You done a big mistake of declaring 3rd passport as lost which was with HO. You should have requested back gently your passport instead declaring it lost. HO MIGHT give you a tough time & might consider it as a matter of deception.
