Questions about ILR application

Post by damnmad » Tue Jan 23, 2018 3:27 pm

Hello guys,

Its been very longtime, hope you all are doing well.

Where I am :

I got my visa with the following stamp :

PLACE & DATE OF ISSUE : UK 04-05-2013

Did have 1 break due to redundancy, which was less than a month time. Switched (only once in 5 years time) to another employer within less than a month time of the last date of employment.

Took small breaks to travel out of country as part of holiday, around 8 times.

My questions/concerns are :
  • I know that a person can apply with in 28 days of the completion of 5 years time, so ,when does my 28 days ILR period starts? 7th April?
  • Can I book the priority appointment starting from Mid march? If I book for one day appointment prior to the 6th April for dates after 6th April, will I need to pay old fee or new fee?? (who doesn't want to save some bucks :D)

Same concern with application too, If I book for a slot in march for around 10th April will they reject my application because it was previous financial year's application (concern about application version) or ask me to pay the new fee?
  • Do I need to cover all the breaks with letters from my previous employer + the current employer stating the dates (with reason? just checking)
  • I do have all the payslips + the redundancy letter + P60's (yearly tax return forms), Should I get my 5 years Tax history if I miss something from the P60's??
  • Around same time, I'm applying for my parents/in-laws visiting visa, is it a good move to do so? Will it have any impact if my visa status changes or remains same?
  • Any suggestions from members who have applied recently would be very welcome :)
Really appreciate any replies.

Thanks & Reg.

Tried to add this, but didn't allow me to add :

Another question I have (sorry)
  • My Wife has joined me as dependant in March 2015, I belive she still have time for till 2020 for her ILR application, but we are expecting baby, date around July, most likely after my ILR application. So the child can become citizen straight away? or if it differes please explain.
Never mind!!!

Assuming you are on Tier 2 (your post doesn't say), you can use your visa issue date to calculate the 'within 28 days before'.
Can I book the priority appointment starting from Mid march? If I book for one day appointment prior to the 6th April for dates after 6th April, will I need to pay old fee or new fee?? (who doesn't want to save some bucks :D)
Yes should be fine and yes you should be able to pay old fees (been like this in the past but anything can of course change with HO). You would need to be vigilant to check as March appointments are booked up incredibly fast with members trying to avoid the fee increase on 6th April.
Same concern with application too, If I book for a slot in march for around 10th April will they reject my application because it was previous financial year's application (concern about application version) or ask me to pay the new fee?
No. It has nothing to do with 'previous financial year'.
Do I need to cover all the breaks with letters from my previous employer + the current employer stating the dates (with reason? just checking)
You need an absence letter from all employers you have had.
I do have all the payslips + the redundancy letter + P60's (yearly tax return forms), Should I get my 5 years Tax history if I miss something from the P60's??
Again, helpful if you state the route to ILR you are applying through. You don't need P60's for Tier 2. Then again, you don't need tax returns either.
Around same time, I'm applying for my parents/in-laws visiting visa, is it a good move to do so? Will it have any impact if my visa status changes or remains same?
They need to meet the requirements themselves for a visitor visa.
My Wife has joined me as dependant in March 2015, I belive she still have time for till 2020 for her ILR application, but we are expecting baby, date around July, most likely after my ILR application. So the child can become citizen straight away? or if it differes please explain.
Yes, child will be automatically British. Re your wife, again useful if you stated the route and visa you are on.

In general, I wouldn't mind but my date comes around the April 6th or 7th, just want to make sure my calculation is right.

You mean number of people booking up in March for April appointments due to fee changes?

You need an absence letter from all employers you have had.
Sure, I will collect them, thanks.

Yeah it is Tier 2 route, then what they expect to see with my application regarding my Tax or Salary and prove that I'm not using any public funds??

Make sense.

In general, I wouldn't mind but my date comes around the April 6th or 7th, just want to make sure my calculation is right.
Earliest you can apply is 6th April. Important to note that it is WITHIN 28 days before reaching 5 days, it does not have to be exactly 28 days.

Payslips and bank statements. You are earning required amount right??
Do I need to cover all the breaks with letters from my previous employer + the current employer stating the dates (with reason? just checking)
You need an absence letter from all employers you have had.
Sure, I will collect them, thanks.
You also need a letter stating you 'are required in XY position and will be paid X salary for the foreseeable future....'
My Wife has joined me as dependant in March 2015, I belive she still have time for till 2020 for her ILR application, but we are expecting baby, date around July, most likely after my ILR application. So the child can become citizen straight away? or if it differes please explain.

Your wife can obviously continue on her current visa until such time as she qualifies for ILR on SET(O).

Makes sense, just want to clear once again;

So I can book an appointment for any date after 6th April during March and pay this year's fee.

So will keep my payslips and bank statements intact, Yes I am earning the right amount (36k PA).

Yes, this has been the case in the past. Whether HO changes that in the future, we don't know.

3 months of each will be sufficient. Presumably you have not had a sudden increase to over £35k, as this would be a red flat to HO.

Sure thing, 3 months should give better picture.

Nope, my salary was on 36k from 2016 September, so should be ok I guess.
