Good Character Requirement Discretion

Post by southamerican » Thu Jan 25, 2018 6:49 am

Hello everyone!

Hoping someone will be able to give me some advice, this has been worrying me for the past few days...
I'm planning to apply for BC in a few months. I entered the country on a fiancee visa on 24/06/11. Was granted temporary leave to remain in February 2012.

Now, in late November 2013, I lost my wallet, which had my BRP in it. When I cancelled it, I was told I had 3 months to apply for a new one. So I did and I received my BRP replacement in February 2014. However, the listed issue date was 18/02/14 whilst the expiry date was 8/02/14 . I was shocked and scared, emailed the Home Office and they answered saying I should apply for ILR as a matter of urgency. At the time, I didn't have the sufficient funds so had to very quickly save up. Submitted my IRL application on 24/03/14 and was granted ILR on 16/07/14.

I have been worrying that time period in between February in March will prevent me from obtaining BC. What confused me though was that I had an appointment with a solicitor and she said there shouldn't be any problems? She even checked with other solicitors in the building and they all said it should be fine. So now I'm very confused.

If anyone could shed some light on this matter, it would be greatly appreciated.
Thanks!

I doubt that you have breached any immigration laws. The fact that you applied for a replacement BRP and HO issued one for you with an already expired date is their own responsibility.
