If you or your spouse dont have ILR or UK passport it will be refused stragiht away.
Whats your current status in UK?
There is a bit of an obscure loophole where if no nationality has ever been actively established and the child, born in the UK, has lived in the UK for 5 consecutive years, then they can apply under 3.5. There was a thread on the forum about them possibly closing this route, but as far as I'm aware, while it was discussed, it's been left intact.
