Tricky ILR Timing

Post by keledrena » Mon Jan 29, 2018 11:14 pm

Hi all,

I'm hoping to see clarification on ILR rules, or at least a bit of guidance of whether it's worth paying for specialist advice/guidance!

I first entered the UK on a student visa in 2010. In 2013, I switched to a Tier 2 general work visa sponsored by my current employer. I'm nearing my 5 year years eligibility to apply for ILR, but am also about to receive a job offer by an employer that can't sponsor, and which would initially require me to be out of the UK for the first year (let's leave aside the point about needing to maintain residency in the UK to keep ILR).

What I'm trying to figure out is the following:

1. As I was already in the country and merely switched visas in 2010, does the "clock" begin when I got my certificate of sponsorship (May) or my biometric permit (June)?

2. When you apply for ILR, it says that you will need an additional letter from your currently employer verifying your continued employment. Do you know if they will check with the employer? (Here I am trying to figure out if I need to wait to hand in my notice).

3. I read on that I can apply 28 days in advance (e.g. 4 years and 11 months on the Tier 2) - is that true for the 1 day speedy application?

Thoughts on any of the above welcome! Thanks!
