Hi guys
Forgive me if this has been posted before but i signed up as i needed help. I married my Moroccan partner in December 2017. I wanted to apply for the spouse visa, but struggling with the Financial Requirements element. My current salary is £17400 ( i just changed job roles within the same company in october so i don't know if that makes any difference as my payslips are still coming from the same company but salaries have changed) per year which falls below the £18600 i need, however i do overtime regularly and i receive 2 annual bonuses in August and February. My partner hasn't completed his tb test so we are waited for this and also his proof of english language so most likely i won't submit my application till early April. My Gross Pay for my last 6 payslips look like below. My usual gross monthly pay is around £1455 which i know isn't enough. i receive 2 bonuses annually in August and February of aproximately £900 plus overtime which varies anywhere between £50 - £150 a month. i wanted to ask since my payslip in december took a big hit as i took unpaid leave should i apply under salaried or non salaried. My next payslip should be larger at approximately £2500 and i am also due a pay increase in march so hopefully that will strengthen my application. my only worry is the financial requirements.
so far this year from April 2016 to January 2017 my total gross earnings come uo tp £19700 so i know i have definitely earned more than required, however how would i calculate this. add up all the lat 6 months paycheque, divide by 6 to obtain a monthly average and then x's by 12 to find an annual amount (which gives 9831/6 = 1638.5, then times 12 = 19662 which is above the threshold.as it hardly seems fair that they should use my lowest payslip as my bonuses and overtime push this further. also the figure i use in the financial requirements would that be the amount after i have done the calculation including overtime or just what my gross salary is as i don't want it to fail. I will have 12 months payslips and banks statements printed just in case to demonstrate that i have met the requirement but its just so complicated. if the Home office was to use my lowest payslip at 1206 they would calculate annual at £14472 which means i would have to earn at least £2064 In overtime and bonus in last 6 months (might be doable) to qualify so am i better applying under non salaried.

December £1206 (i took unpaid leave to visit my partner)

Any help would be greatly appreciated. I'm so sorry if this has been explained before, i just can't grasp it. I would love to get a solicitor/laywer to help with the application process but its just so costly :( Any help would be greatly appreciated.

Your understanding is correct. Since you earning variable income so better you opt non-salaried person route where the average of last 6 months wages will be taken to calculate annual wages which in your case can meet financial threshold. You can explain it in additional info section/covering letter instead you leave on caseworker to decide who can assume it salaried income where they will take the lowest wages figure to refuse you.

Thank you for clarifying this for me. i have had a look at Appendix 2, which says 3.3 indicate the main method of meeting the financial requirement should i select income from salaried employment in the uk and then Category B. as this is variable income? or should it stay as Category A.? sorry for being so dumb :( i didn't realise it was this complicated

Dear All,

I need your support and guideline. By reading different views and different opinion I am still confuse about financial requirements.

Currently I am on ILR and want to sponsor my wife and 1 child from non-EEA country.

I am working as taxi driver. Gross income about 11k. I understand I can’t not combine self-employed and savings. But Can I go for the following route:

Option A:

Self-employed 11k + employment 13k= 23k
Can I qualify this way?
Do I need to show this for last 6 month or 12 months?
I have savings in my account about 25Kfor the last 6 months.

Option B:

Savings of 25k + third party sponsored 60k ( my brother working and earning over 60k per annum. Can prove through his p60. He willing to help me. He got 20 k saving plus 40 k loan from bank. If he writes letter and giveaway money. Would this be acceptable?.). Plus I continue working as a taxi driver self-employed…. I guess the above 85k in my account for last 6 month would qualify me? I understand the requirement is 72k.

Hi good morning, Me and my husband making an spouse visa application. Iam the sponsor and he is the applicant. I just wanted to ask, my advisor booked and filled the application (VisaUk) on the 20th August, he had an appointment two week but we have teschuled it to October, the last wage slip will come 4 October (Sept Pay) will it effect he application as he applied in August
