Flr (m) Early Extension

Post by bruteforce » Sun Feb 04, 2018 12:11 pm

How soon can one apply for extension of FLR(m)? My spouse's current leave expires at the end of March 2019 but she will be eligible for ILR(LR) in December 2019. In that case, can she apply for early extension or does this have to be within 28 days of her leave expiring? Thanks

Why you are interested in applying early when in all cases she will need extension to reach ILR stage?

I think you should provide her immigration history before spouse visa and date of entry/visa grant so that someone help you.

She will be eligible for ILR (LR) in December 2019 as I stated above. Just trying to ascertain if this would make any sense in terms of costs. If I apply for extension in March 2019 then I will only have 6 months to folk out another £2297 or so, whereas if I apply sooner, then I will have more time to sort out the finances. If this makes any sense.

I think applying earlier than allowed time may breaks the continuity of such visa leading to ILR. Best is to apply 28 days earlier but in your case as you need more time then you can apply 1-2 days before instead 28 days. Just start saving from today.

You are not getting the point. I do not need more time, instead, I have couple of years extra at my disposal.

Extensions may be applied for at any time before expiry of leave. However, by applying sooner, the period avaliable to apply for ILR is shorten.

For example, assuming they grant leave on the date of the application,
If she applies for an extension on 1 March 2019, then she will have time until 1 September 2021 to apply for ILR.
If she applies for an extension on 1 March 2018, then she will have time until 1 September 2020 to apply for ILR.

I understand that, she will be eligible for ILR (LR) in December 2019. If I apply in March 2018, her leave will be extended to September 2020 so I assume there is no harm in applying early.

Yes.

Assuming she qualifies for ILR in December 2019:
If she applies on 1 March 2018, then she will have the period between December 2019 and September 2020 to apply for ILR.
If she applies on 1 March 2019, then she will have the period between December 2019 and September 2021 to apply for ILR.
