Hi,

Many apologies in advance if this shouldn't be the right section for the question that i'am asking. I'am also seeking for some clarification for my understanding on the below scenario as well please.

Brief Background

Wife entered UK November 20009 on spouse visa (2 year route to ILR), applied in time (postal) for extension (not ILR as we where short of money for it) in December 2011.

received letter dated 22 June 2012, refused for the extension application, reason being not providing ESOL language certificate, but, was she granted DLR with no appeal rights.

Question

As i see it, using my wifes example, Would she still meet the good character requirements in respect to the residency requirements?

as far as i understand, once she has attained ILR, and the fact she is still married to a British spouse, her leave in the UK since 2009 has not broken at any point (no overstaying) and she will have had completed the 3 years being resident in the UK preceding the application for Naturalisation. She would also be able to apply straight away without waiting the 12 months required for those not married to a British spouse.

Again i apologise if this has been asked many times, i' am finding most of the information on this mainly for applicants that were granted DLR (failed asylum application thus having to wait 10 years before applying) or information before 2014, i believe they changed the good character requirements after 2014.

HI,

After reading the Good character requirements for British citizenship, I am going to conclude that my wife does not fall within the refusal criteria and that she is OK to apply after attaining her ILR straight away.

If she has held a valid visa etc the whole time, then no issue.

My thoughts exactly, only I was thinking in line that her DLR was granted outside of the immigration rules and maybe that time taken to attain ILR will have counted but may not be counted for in respect of an application for British citizenship.

Again, after reading the Good character requirements, which the majority focuses on and emphasises on criminality thresholds and such, the only mention I had seen in regards to residency was that, if there has been overstaying of 28 days or more then it may be refused.
