I got my Tier 1 Entrepreneur Visa (initial) on 23 of January 2014, My visa was Valid till 20 January 2017. On 18 January 2017, I sent my extension application, that was refused on 13 June 2017, because of not meeting job creation requirement.
I made fresh application on 26 June 2017, received complex letter in July 2017 and after that, no update.
My five years, on Tier 1 Entrepreneur visa will be completing on 23 January 2019, I have one permanent full time employee. I hire one or two part time employees when I need them during periods when work is very busy. Business is busy during certain months of the year, few months are very quiet.
I know at the moment, I am an over stayer. However, if I am granted visa extension in next few months, then period of overstaying will be ignored. My question is, e.g. if I am granted visa extension in April 2018, can I apply for ILR on 23 January 2019, assuming that I’d continue to employ workers. If yes, then what period of employment will be considered towards job creation ? will that be February 2018 to January 2019 ? being the twelve months to ILR ?
