Which will be other alternatives for this case? under the fact I was with leave before April 2011?

Should I cancel the ILR application? and apply for TIER 2 again?

I don`t think anyone here can decide on behalf of you as this is very crucial decision.

So far, it seems like your absences will be a problem for ILR even if you apply for discretion regarding the clause of 11 Jan 2018 change.

Worth to confirm how you extended visa for more than 6 years, and if this is still applicable; extending seems to be the only solution to secure ILR in 2020.

You have mentioned that you work in a university and i believe they should have a unit / desk to assist immigration process. But you need to crack on quickly as your visa will expire soon.

I am not knowledgeable about tier2 at all so this is just an idea based on what you say are major university achievements: Apply for exceptional talent visa.

I think ILR comes quite fast and you (may) be able to shorten time to ILR with previous PBS leave.

Many thanks to all of you. Things happen for a reason and, probably, this is my time to leave and keep contributing in my home country. Probably they need me more. I will try to get as much support from Uni, but this is very low, and I think have met you in this forum has been very useful than talking with any advisor anywhere else...

We will see, lets hope for the best and thank you once again for all your kind answers and post!...

Bear in mind, it is not the easiest visa to get and getting initial endorsement in phase 1 will be your first challenge.

You really don't have a lot of time as your current visa expires really soon.

(i) previously had leave under the Rules in place before 6 April 2011 as:
(1) a Tier 2 (General) Migrant,
(2) a Tier 2 (Minister of Religion) Migrant,
(3) a Tier 2 (Sportsperson) Migrant,
(4) a Jewish Agency Employee,
(5) a Member of the Operational Ground Staff of an Overseas-owned Airline,
(6) a Minister of Religion, Missionary or Member of a Religious Order,
(7) a Work Permit Holder, or
(8) a Representative of an Overseas Newspaper, News Agency or Broadcasting Organisation,

Hello Jorge,

I'm currently in the same situation as yourself - my visa expires in August but I've also been away for work for more than 180 days and as such will fail my ILR application.

Please can you advise were you successful with the Tier 1 Exceptional Talent visa? Thanks.

I am in a similar situation where the absence is well over 180 days due to work purposes.
Is there any update on the case discussed in this thread?
