I would be most grateful for some valuable information on my case as it will help me decide if I can apply for Naturalisation next year.
My scenario is as below.
I have ILR since 2011 Jan. My husband and my minor son are British Citizen.
I lived in UK since 10th April 2013 until 9th April 2017 without any single absences. From 9th April 2017 till 31st April 2018 i am absent from UK with my family due to my mother in laws ill health and hence my absences exceed the normal permitted number of absences which is 270days to apply under spouse of British citizen. However I will have less than 450 days of absences. So, can i still apply for Naturalisation after a year by meeting the second criteria of no more than 90days absences in last 12 months. I have read in the booklet AN under section6(2) applicant married to British citizen that the absences are normally disregarded “if your absences are up to 450 days we would expect you to have been resident in the UK for the last 4 years provided you meet all other requirements and you have established your home family and estate in UK.”
I have a flat in UK since 2011 and family(both son and husband are British) and all our earnings and savings are in our bank accounts to prove. Can I apply and request for discretion on my excess holidays. Will my case be strong enough for taking a chance to apply under discretion?
If I am eligible to apply for Naturalisation next year my situation on residency requirement would be as below.
10th April 2013 to 10th April 2017 - No absences
10th April 2017 to 31st April 2018 - more than 270days but less than 450 days of absences.
1st May 2018 to 1st May 2019 - No absences.
With above absences can I still apply for British citizen/Naturalisation under section 6(2) of spouse of British citizen rule.?
Please kindly advice if my knowledge on the above is correct and if so can I apply early next year. I would like to apply through a solicitor as my case doesn’t seems straight forward. Please can someone share their experiences/outcomes if they were in same situation. Any advice would be highly appreciated and many thanks in advance.
