FLR (FP) or FLR (O)?

My partner was previously granted 2 DLRs starting in 2010 and expiring this month on the basis of parent of UK children. He had wished to apply for ILR this time but hadn't realised he would need UK test or English Language test so will have to apply for further leave to remain but this time on basis of partner of UK national. Which form should get use? We were told by CAB that it would be FLR (FP) but are not sure please help :(

DLR visa holders don't require LIUK or English test for Set(O) ILR. See page 5 in the link below.

He will however require both tests for British Citizenship application.

He could have also applied for ILR 6 years from the date he was first granted DLR.

Many thanks the issue though is that since he hasn't taken KOLL he will have to apply for a further DLR instead of applying for ILR but we don't know if he should use the FLR (FP) or FLR (O) form?

You are misunderstanding. If he has held DLR for 6 years, he is EXEMPT from KOLL, ie. he DOES NOT have to do it to apply for ILR, as the link I have provided clearly states.
The following categories of people do not need to meet the KoLL requirement:
• victims of domestic violence
• foreign and Commonwealth citizens on discharge from HM Forces (including
Gurkhas)
• highly skilled migrants applying under the terms of the Highly Skilled Migrant
Programme (HSMP) judicial review, and their dependants
• bereaved spouses, civil partners, unmarried partners or same-sex partners of
people present and settled in the UK
• parents, grandparents and other dependent relatives of people present and
settled in the UK, applying under paragraph 317 of the Immigration Rules, even
if they are aged between 18 and 64
• adult dependent relatives, under Appendix FM of the Immigration Rules, even if
they are aged between 18 and 64
• retired persons of independent means
• people applying for ILR as a refugee
• people applying for ILR on the basis of discretionary leave
• people applying for ILR on the basis of humanitarian protection

Many thanks now I see what you meant :) however his dlr is not 6 years continuous and he doesn't have the fees for ILR so will be applying for dlr in interim but not sure if he should use the FP or O form from FLR?

Hi

I think FLR(O) has been replaced by FLR (HRO)

As you state you where granted DLR and wish to continue by applying for a further grant, I believe this may be the right form to do so, but do read the guidance to confirm it is the case.
These are my 'views' and 'opinions'.
If in doubt always seek professional advice, or at least do a search for the relevant information. :P

If i make any mistakes, You are more than welcome to correct me.
