Marrying On Tier 4 Visa then going to USA

Post by hannahash » Tue Apr 03, 2018 9:35 pm

Hell there me and my fiancee are very confused, he proposed on my birthday in early March which was amazing but also has us wondering how we are gonna be together. As I have been away from my family for three years only visiting for Christmases (which he came along with this past one) we decided that going home to live with my family would be best.

Currently our situation is this:
We have been together for nearly a year now which doesn't sound like much but we live together (my name is the only one on the contract), spend every day together, and it's one of those when you know you know sort of things.

I am in the UK on a Tier 4 Visa and have been since 2015, my visa expires October 2018.
He is a British Citizen, born and raised here all his life.
We don't know what our best route would be we've looked into marrying here (we know to give notice to a home office registrar and receive in interview within 78 days) and applying for K-3 visa

We've also looked into applying for a K-1 Fiance visa and marrying in the US then adjusting the visa.

Whatever we apply for will be done with us both in the UK which also seems to be complicating things.

Also, regarding sponsorship, as I am not in the best financial position both my mother and father have offered to co-sponsor him.

Basically we just want to know the best option to go down that includes us married and in the USA.
We're just terrified of being separated and the anxiety over it keeps us up at night knowing October will come soon.

Thank you for all the help if you need any more information let us know!

This board is about Tier 4 visas. Your query seems to be about your fiance applying for a visa for the USA on the basis of marrying you, so I advise he gets immigration advice from someone who knows the system in that country, including about whether your current situation living in the UK has any bearing on it.
I do not give immigration advice. I refer you to Immigration Rules, guidance, other online content and to your sponsor.
