RE: Application for Indefinite leave to remain in the UK as the spouse of a PBS applicant who is now settled
Dear Sir/Madam,
APPLICANT NAME: - .............., D.O.B. ........, NATIONALITY: Indian
I, Mrs ........... wish to apply for Indefinite Leave to Remain in the UK as the spouse of Mr ........ settled in the UK as a PBS applicant. I intend to live permanently with my husband for rest of my life. Therefore, requesting you to kindly grant me the Indefinite Leave to Remain and would be grateful if the application can be processed.
My husband Mr .........., Passport number-........ is now settled in the United Kingdom. He has been living in the United Kingdom since 24/01/2007. He got his first 3 years Tier1 (General) visa on 05/05/2010. On 14/05/2013 his Tier 1 (General) visa again extended and valid until 14/05/2015. On 22/04/2015 he got his Indefinite Leave to Remain. I enclosed his original BRP letter from Home Office to show this as well as enclosed his British Passport.
I got the entry clearance as a TIER 1 (GENERAL) PARTNER visa on 16/07/2013 valid until 14/05/2015 in Kolkata, India. After my husband’s successful application of ‘Indefinite Leave to Remain’, I have applied for PBS dependent leave to remain. My application was approved by Home Office and the issue date of the BRP card is from 18/06/2015 valid until 18/06/2018. I have been living with my husband in UK since 09th September 2013. I can confirm that our relationship is subsisting and I enclosed the relevant documents for proof.
My initial TIER 1 (GENERAL) PARTNER visa issued on 16/07/2013 and I first came to UK on 9 SEP 2013 i.e. after 1 month and 25 days.
Hence, for the Continuous Period Calculation; I request you to kindly consider my first visa issue date i.e. 16/07/2013.
Below are the relevant dates including absences from UK for Continuous Period Calculation:
1. TIER 1 (GENERAL) PARTNER visa issued on: 16/07/2013
2. Date of initial entry to UK on: 09/09/2013
3. TIER 1 (GENERAL) PARTNER visa valid until: 14/05/2015
4. PBS Dependent Leave to Remain issued on: 18/06/2015
5. PBS Dependent Leave to Remain valid until: 18/06/2018
I was outside of the UK during the following days:
1. 16/08/2016 to 15/10/2016 (61 days, Holiday to my home country India)

14. For address proof: Individual Current Bank account statements, 3 x NHS letter, 1 x Halifax bank letter, 1 x Electoral Registration Letter
15. For subsisting relationship: 3 x Council Tax, 3 x Water bills, 3 x mortgage annual bill
DOCUMENTS PROVIDED BY ILR HOLDERS:
1. British Passport
2. Original Biometric residence permit letter
3. 3 months’ salary slip
4. 3 months bank statement ( showing the mortgage payment as all other bill payment)
*** Dear all as after naturalistion NCS retained my ILR. That's why I attached the letter only. However, I have the print out copy of my ILR. Shall I attach this as well.
