Regaining British Citizenship

Post by UTMatt » Mon Apr 23, 2018 8:36 pm

BACKGROUND

Brought up in Northern Ireland, so am both British and Irish.

Wanting to bring non-EU spouse to live in NI but impossible due to financial requirement.

Have been advised by the Citizens Advice Bureau that a possible way to do this would be to renounce British Citizenship and bring spouse to NI by exercising EU rights as an Irish-only Citizen living in the UK, then spouse would be entitled to an EEA Family Permit visa.

QUESTION

If I were to renounce British Citizenship as advised, would I later be able to regain that British Citizenship as an Irish person living in the UK, having satisfied the 5 years residency requirements? Or would I forever be blocked from regaining British Citizenship because I once had it and renounced it?

Thanks for the advice.

"You have a separate right (once only) to be registered as a British citizen if you renounced
citizenship of the United Kingdom and Colonies:
• in order to keep or acquire the citizenship of a Commonwealth country, or
• because you had reasonable cause to believe that you would be deprived of
your citizenship of a Commonwealth country if you did not renounce.
5
If you renounced citizenship for any other reason, or if you have already renounced and
resumed British citizenship (as a right), registration is at the discretion of the Home Secretary.
(Registration will be granted if he or she thinks fit)"

Discretion may not be in your favour if your reason to renounce British citizenship was purely to get around (circumvent) the Immigration Rules for dual Irish/British nationals.
