Need advise on the correct route of application

Hi all, I’ve lurked around this forum from time to time and gathered some invaluable advice. This is my first time posting and I am hopeful that the knowledgeable regulars would be able to steer me in the right direction. I came to the UK in 2007 on a student visa, got married in 2010 to a British citizen and changed to a spousal visa. My marriage broke down in 2012 and I switched to a tier 2 visa in 2013. Now I have been made redundant. I have a 6 year old child who is a British citizen and I have a regular role in my child’s life backed by a court order. I am also in a relationship with an eu national and we have been living together for 5 years, but are not married. I would highly appreciate if someone could suggest what would be the best way forward to continue my life here. Thanks.

Maybe you were not aware that spouse visa granted under old rules prior to 9th July 2012 led towards indefinite to leave after 2 years and you must had applied that one on that time. I am not sure that whether can you claim such time to be counted towards indefinite leave now.

Thanks for getting back. Sorry didn’t make it clear in the post but my marriage broke down just before the two year period. I then went back to india and a made a tier 2 application. Altough the application was made after a week of being there the decision took just over 6 months.
