HELP!!!!!!

I have my visa appointment coming up this monday - and despite all my reading up, i have managed to miss the small clause that says if your sponsor is employed by a company where their parents etc are an owner - you need to supply a whole lot more evidence, and fill in the form as if you were a director of the company.

The company is quite a big company (a 100+ employees) and my partner is just another employee.

However, now i am REALLY thrown off filling in the form - as it tells me i need to fill in the finanical section F. Which all the questions are about "how long have you been self employed?" etc - but my partner is not self employed so it feels like it makes no sense. The questions for section A make more sense.

Does anyone have any experience of how i should answer the self-employed questions when my partner isn't self employed.

The official wording is below for reference:
Paragraph 9(a) of Appendix FM-SE states that the specified type of limited company is
one in which:
(i) the person is either a director or employee of the company, or both, or of another
company within the same group; and
(ii) shares are held (directly or indirectly) by the person, their partner or the following
family members of the person or their partner: parent, grandparent, child, stepchild,
grandchild, brother, sister, uncle, aunt, nephew, niece or first cousin; and
(iii) any remaining shares are held (directly or indirectly) by fewer than five other
persons.
5.5.15. Where a person receives a salary from employment as a director or employee (or both)
of a limited company in the UK of the type specified in paragraph 9(a), that salaried
income can only be counted under Category F or Category G, as appropriate. See
section 9 of this guidance.

Unless the business has heavy turnover and high fame in market the HO will perform rigorous checks over family business. But still I think your partner should be a worker instead self employed if his employer pays his taxes.

I applied for my husbands visas last year & I was the sponsor. I work for a company that is owned by my parents and I supplied just the normal evidence they require for Category A & was granted the visa with no issues.

I imagine extra checks might be made if you work in a family company but I have never seen that extra documentation and evidence is required in the application. Usually HO will contact the employer to ask questions if they want to verify the employment.

If you are employed through PAYE and everything is legitimate, I can't see that there would be an issue. What other evidence could the HO even ask for?

I see the clause you are referring to but perhaps it is taken out of context? It does not seem accurate that you apply as a director/self - employed if you are a PAYE employee.

My wife and I are in a similar situation.

I am a British Citizen and wife is Turkish. She is due to extend her Spouse Visa soon, and she is working as a full time office assistant at my company (I am the sole Director and Owner - around 30 employees). She is a "normal" employee, with PAYE salary exceeding the financial threshold. Whilst I own the company, I too am a "normal" employee and only get a PAYE salary, I do not have any other income and take no dividends. I am not self employed and neither is my wife.

So we are confused with paragraphs 2 and 9 of Appendix FM. It seems that if we show my finances (PAYE income) then we need to follow paragraph 9 and provide the long list of company documents. However if my wife shows her finances (PAYE income) then how does it work when her employer is essentially me, her husband?? Who writes her confirmation of employment letter?? etc etc,

No one seems to know
