ILR financial requirement confusion

Post by sherali » Sun Apr 29, 2018 10:52 pm

Dear all,

I am a British citizen (through Tier 1 route) and my wife is on spouse visa (spouse/partner leave to remain). Her 5 years on this route will be completed in 2019 and will then be eligible to apply for ILR. As far as I know she will be using SET(M) application and minimum financial requirement for her application would be £18600. My annual income exceeds the minimum requirement but my income is coming from 2 different permanent jobs. In one job I am getting paid monthly while in my second job I am getting paid hourly and getting paid 4 weekly. The income form my second job can vary depending on the number of hours I work each week though I almost do same hours every week but it can change some time.
My questions are

1. Can I combine income from these 2 employments to meet the financial requirement (£18600) for my wife ILR?
2. is SET(M) the correct application for her to use?

Many thanks

Yes you can. All legal income can count toward 18600.

Dear Cyclina1,

Thanks for your reply.
With regards to the income requirement I've read a document (Appendix FM Section 1.7) which says that only either salaried or non salaried employment can used. Both of them can't be combined to meet the requirement. As one of my employment is salaried and the other one is probably non salaried as I am getting paid on hourly basis after every 4 weeks though I do the same number of hours every week and entitled to paid holidays too. Please could you follow the link below and read page 17 and 18 of the guidance to see unless I didn't interpret it correctly.
