I am granted ILR based on completing 5 years in the UK under Tier 2 general. I have a question for my wife's ILR application.
Currently, she is holding tier 2 dependant visa until 28/08/2018. She got her first visa on 15 July 2013 and enter the UK with that visa on 12 September 2013. So she will be completing "5 years with visa" on 15 July 2018 and "5 years in the UK with me" on 12 Sept 2018. My question is when she can apply to ILR.
I see the rule for dependant is different and we cannot count the days from visa issue date. it is written that dependant should spend 5 years with main visa holder, in the UK which makes me think 12 Sept 2018 is the date she is qualified. I also suppose she can apply 28 days before qualifying period so she will be able to apply before her visa expires on 28/08/2018. is it correct? is 28 days rule still applies? what do you think?
