General 2 visa sponsorship elegibility

Hi,

I was on a long term ict tier 2 and i left my previous organization in march 2017 and left UK the same time but my ICT is still valid until Nov 2018. Now I had applied to one of the position with the same employer and they have offered me the job. Now my question here is can the same employer apply for General visa tier 2 ?

2. Does cooling off apply in my case ?
