Some Advise please Tier 5 to Tier 2

Post by Nojustice » Wed May 30, 2018 3:48 pm

Hello,

Please can you help with some advise for a work colleague

This young lady is from Taiwan and is currently on a tier 5 (Youth Mobility), this visa expires on 15/06 and she has already arranged to fly home

The company that we work at has provided her with a CoS however it says that it is a Tier2 (General - Switching Immigration Category)

From looking at documents, it doesnt appear that she is actually "switching" as she is leaving the country in order to apply for a new visa

Is this the right Category that the company has provided her a CoS for, she is worried about the financial implications on her should she be refused a visa due to this.

Any help would be much appreciated.

I don't think that's right. She needs to leave the country and gets a restricted CoS

Her CoS states the following:

Does the migrant need to leave and re-enter the UK during the period of approval? Y

So I think that is accurate, however is the actual CoS correct for her?
