Hi, I am looking into returning home to the UK from the US with my US Spouse. I am a UK citizen. Both our children are UK citizens. I am looking at the family visa for my spouse. I understand the requirements mostly but one thing is not clear: I am employed in the US currently, financial level exceeds the 18,600 pounds pa requirement. It says on the UK.GOV page regarding the family visa application:

What counts as income
You and your partner can use:

income from employment before tax and National Insurance (check your P60 or payslips) - you can only use your own income if you earn it in the UK

- this relates to my spouse applying. I am the 'partner' in the above. Can I use my current US salary to support the application or not? If not, does this mean I have to secure a job offer in the UK first, return home alone and work in it for 6 months before I can even apply for my spouse's visa?

Your US income will only be counted if you have the job offer in uk within 3 months of arriving. Otherwise come alone and work for 6 months.

For clarity, you (as the sponsor) are required to submit evidence of earnings the equivalent of £18,600 for the 12 month period prior to submitting the application AND have a confirmed job offer to start within 3 months of arriving in the UK, again meeting the minimum earnings level of £18,600 p.a.

You must also show that you have adequate accommodation for your family, available on your arrival in the UK.
(Casa, not CR001)
