Applying for a UK spouse visa from italy as a refugee

Hello all...
Pls I really need an advice regarding my spouse visa application. My wife is a british citizen and has meet the finiacial requirement with suitable accommodation. I have also passed the A1 English exam, but have not gotting my italian residence permit yet but i have a ten years italian identity card. Am a refugee in italy I came by boat from Libya. I failed my first asylum appeal but has made my second appeal. My Italian lawyer told me that my second appeal process will last for two years and that I have right to stay in italy for these two years until my result is out. My question is can I still apply for UK spouse visa in italy with my court appeal papers and my Nigeria passport... pls I really need an advice.. thanks all
