Please advise

Post by Bella21 » Mon Jun 11, 2018 10:51 am

Good Morning all,

Hope you can clarify my situation...

I've got my permanent resident card of eu family member last december....not long ago my husband needed to go home and sort a few things over there and he decided he wants to stay there and start a new life without me, he found a girlfriend etc....this june it could be 7 years of anniversary. :( .. i decided to go abroad for a holiday to have some time without stress as im having not a great time at the moment...im a bit concerned if they will let me back to uk as on my card written "permanent resident card of a family member. eu rote to recide"...im still a family memeber but he is not in uk anymore and we will apply for divorse soon...please advise if it's ok for me to go and i have my own right to be in uk on my own now or do i need to find an inmigration solicitor?....i have a permanent job and never claimed any benefits...as well im planning to apply for citizenship this autumn...
Thank you nice people...

Once you have acquired permanent residence in the UK, your right to reside in the UK is independent of your EEA Citizen spouse. So, even if you are divorced, your PR Card and PR Status is still valid.

Thank you Simon...just from my previous experience when i used to have a residence card of a family member they have been questionning me at boarder control if im still a family member, if we are still together etc... what if they will do the same this time? As far as i know i aquired my permanent card on regulatiin 15 and the only way to loose it is to be away from uk for more than 2 years? Is it correct?

Correct.

While you had a Residence Card, the validity of your stay was based on you being a family member. Once you have acquired PR, you hold it in your own right and are no longer dependent on the EEA citizen.

And at the very bottom is written "residence card of a family member" - thats why im concerned...do i still have my own right to recide and i dont depend on my eu spouce anymore even if its written on the card that is is a card of a family member of eu?

Thabk you

Hi all, just to let you all know they let me in and no questions were asked rsgarding my husband. The only question they have asked me was how have i obtained a permanent residence. Thats it.
By the way if you have your vignette in passport for recidence card of a family member of eu, you dont have to go to non-eu line and fill in the immigration form as u can use eu line and just show the officer your eu recidence card vignette in passport first and after show ypur permanent residence card and u dont have to fill in the immigration form
Hope it can help someone😊
