ILR dependent

Post by aullah360 » Tue Jun 19, 2018 2:22 pm

Hi,
My last visa was PBS tier 2. In May 2018 I have got my ILR on 10 years basis.

My wife is on PBS dependent since she is the UK under my PBS tier 2. Her Visa will finish in November 2018. She is with me in the UK for about 2 years now.

Which Visa should she apply for, when and what are the documents do we require. and also when she can apply for ILR. It will be great if I can get some of your help.

Thanks
Arif

Spouse visa on form FLR(M).

You must meet the financial requirement and your wife must meet the English test requirement.

She will qualify for ILR after 5 years on FLR(M) - 2 x 2.5 year visas.

Thanks for your quick response sir,
as she is already with me as my dependent for last 2 years. will it not count for her ILR?

No it does not, she loses the time already spent for ILR based on 5 years residence. FLR(M) will reset her 5 year clock to zero. The rules changed 4 year ago where they removed the rule that PBS Dependent can combine PBS Dependent time with FLR(M) time to make up 5 years.

No there is not. The quicker route for her would have been if you had stayed on PBS route and got ILR based on 5 years residence as she would have been able to continue extending her PBS dependent visa

Thank you very much for all of your help sir. you have cleared all of my confusion.
One more confusion to clear . could you please help on this.

I have changed my immigration status from Tier 2 to ILR on 10 years route in may 2018. But my wife's immigration status still under Tier 2 PBS dependent. on Biometric card it said it will end in November 2018.
So when would she apply for her FLR(M)? How long is her PBS Dependent visa valid?

She can apply at any point before her visa expires but it is risky to leave the UK if she has travel plans, she should then switch before she travels.

Hi,
I was one Tier 2 . in may 2018, I have changed my status to ILR. But still, my wife is in tier 2 PBS dependent.
I am still working in the same company that sponsored my tire 2.

Now We need to travel abroad. will it be safe to travel together with this immigration status.

Has she not switched to FLR(M) spouse visa yet?? It is risky to travel and she should switch before she does. You working for the same company is irrelevant.
