Hi msandhu62,msandhu62 wrote: ↑Wed Jun 20, 2018 1:03 pmI was granted Tier 2(General) visa valid from 28 Jul 2015 to 28 Jul 2020 (for 5 years)
My age at time of application was less than 26 years (DOB: 26 Feb 1992)
When I applied for Tier 2, my salary was £25K based on salary requirement at that time for SOC code 3545 as a NEW ENTRANT.
My visa would complete 3 years on this 28 Jul 2018 & my age at that time will be more than 26 years.
As per Immigration rules (Appendix J), Sub-para: 14. (d) (iii); for leave beyond 3 years and 1 month; payment of EXPERIENCED WORKER salary rate is mandatory.
Does this mean that I need to be paid experienced person's salary after 3 years and 1 month? Also if my employer is needed to update these changes in salary at UKVI’s SMS?
Present EXPERIENCED WORKER annual salary for my SOC code 3545 is £33300 & currently I am getting £25000.
Request your kind advice so that my next visa extension/ILR application do not face any problems because of a lack of clarity towards appropriate salaries to be paid to me beyond 3 years.
Dear Arnair, arnair wrote: ↑Mon Jun 25, 2018 10:59 amI have gone through the above scenario and unfortunately, you should earn experienced worker's salary after 3 year 1 month. It's clearly written in their guidance. Please check page number 100
