Live CoS and changing employers

Post by Hend » Thu Jun 28, 2018 10:22 am

Hi,
Can someone tell me what does exactly the term (Live CoS) refer to?
I know it refers to the CoS assigned by a sponsor but haven't been used yet to apply.
My case is that i used the CoS and the visa is granted. However, the start date this current 3 years CoS is next July 4th. So practically, i haven't started my new contract yet. Now i want to change jobs and my new employer wants to issue a new CoS within the next 2 days (before July 4th).

So in this case, does the current CoS is considered active and thus my current employer needs to withdraw it before the new employer applies for the new one? I'll then lose both jobs if the new visa is refused

As far as I know, this information is wrong. The OP has been granted the visa with the previous COS as he says.

So it should be fine to get a new COS and to make a fresh T2 employer switching application.

Best to wait for a moderator to answer. Good luck!

To add a small note, have a look at the below article.

Under,
"What if you have a UK Tier 2 Certificate of Sponsorship but decide to work in another position in the UK?"
The COS becomes live after assigning, but you haven't been granted the visa with that COS. (As per my knowledge)

In this case, you've been granted the visa for the COS. So there is no more a live COS! (I guess)

You're totally right.
When i found different answers, i contacted an employer who said that since the CoS is already used for application and the visa is granted, there's no need for the current employer to withdraw the CoS since it's not active anymore.

Thank you so much for your help :)
