EEA4 / PR changing nationality

Post by gemig » Thu Jul 12, 2018 5:06 pm

Hi all,
I'm a Italian / Brazilian citizen and my wife is a Brazilian citizen. We got married in 2014 and not very long after that we decided to move together to UK.
We went through the normal route of EEA-FP then EEA1/2 and now her permit is valid until ~ 2019/2020.
Since brexit is around the corner we plan on applying to EEA4 and the permanent residence cards as soon as we are complete 5 years. The thing is that recently I noticed that my wife can acquire Italian citizenship by marriage, but if we pursuit this route, won't it be a bit confusing to Home Office?
A) Is it better just keep the same situation and don't apply for IT citizenship?
B) Is it better to apply, but not mention it when it comes time to get the Residence Permit?
C) Is it better to apply and then use the new passport from now on?

Yeah, bit tricky, hope someone got any ideas :) Cheers!

I think (B) is slightly better so long as you can avoid lying. If Brexit doesn't happen, then you can qualify for permanent residence on the basis of your wife's employment if she is Italian, and you are unemployed for a while. On the other hand, if Brazil had a political disaster, she may for a while be able to fly to Italy on the basis of British-issued PRC and a Brazilian passport, whereas a British-issued DCPR and a Brazilian passport would not work.

The Home Office ought to be acquainted with spouses of Italians becoming Italian while they reside in the UK. It happens often enough.
