Tier 2 general extension - “exceptionally complex issues”

Hi,

I have applied for tier 2 general extension in may( current visa valid till mid August). Have applied for 2 dependents, wife and child. Received a letter stating that my application raises exceptionally complex issues so would require longer than the standard 8 weeks to process.

Nothing in my job circumstances have changed, and I am a doctor working for the NHS with adequate salary for tier 2 visa. The only thing different we can think of is that my wife is currently on an independent tier 2 visa(also till mid August) and has now been applied for as my dependent. But she has previously been my dependent when we were earlier working in the Uk on a tier 5 visa. Child has always been my dependent.

Has anyone else been in a similar situation? And what do the exceptional conditions refer to??? Also if this gets delayed can we legally continue to work? Both our current contracts end on 31st July and new contracts start from 1st August.

Would appreciate any help on this if anyone’s been in the same situation!

It could well be that they are just backlogged. :roll:

I had the same letter and it wss the most straightforward application ever. Basically, don't panic yet.

Thanks for the reply. If you don’t mind sharing, what was the duration between you getting the letter and then getting approval?

I applied Priority, instead of 10 days it took about 32 days until I received my BRP.

Hi Doc,

I applied visa to change the sponsor in Tier 2, currently working as Physio in NHS and moving to NHS.
Applied on 10 may 2018
Biometric given 16-05-2018
Posted the documents :21-05-2018

I received the letter on 29-06-2018
Letter content :although we decide every application with in 8 weeks time but in your case it’s not going to possible . We need further time to check thoroughly to decide your application.

I am worried . Now it’s 10 th week no response .

An update for anyone else who may be in the same situation reading this post. We got our BRPsafter a delay of over a week beyond the usual 8 weeks.

So the timeline that went was

Date of application - 16/05/2018
Date of biometrics and posting documents - 19/05/2018
‘Exceptionally complex issues letter’ dated - 11/07/2018 (received 13/07/2018)
BRPs received 20/07/2018

Locked
