renewing BRP

Post by piousone » Mon Jul 16, 2018 6:13 pm

hi

I would like some advice on how to renew my husbands BRP , he works full time since he came here however since i had a baby i no longer work will this affect his application to renew. also due to some unforseen circumstances we no longer live in the house that i first made the spousal visa application instead we live with my mother and our two children. we are now saving to get a place of our own again will this affect his application to renew.

i would really appreciate some advice on this matter,

Sincerely
S

Presumably he has been here for almost 2.5 years??

What date did he enter the UK on his spouse visa and what date does it expire?

He needs to apply for another 2.5 year visa extension on form FLR M and meet the English A2 requirement and the financial requirement. He can use his salary to meet the £18,600pa.

He will have to pay £1,033 visa fee for a postal application plus £500 immigration health Surcharge. An in person same day appointmwnt costs an extra £610.

No issue re address provided the property is not overcrowded and you have 2 years documentary evidence of cohabitation.

A spouse visa extension will be refused if you/he does not meet the £18,600pa financial requirement for a minimum of 6 mo this or have su Stan tial savings.

If you don't meet the required income, he can apply on FLR FP 10 year partner route, which is 4 x 2.5 year visas

The 4 x 2. 5 year visa on form FLR FP is if he doesn't meet the financial requirement and means he has to wait 10 years for permanent residence.

Not the easiest visa to get.

The normal spouse visa on form FLR M is better but he must meet the requirement, there is no discretion. On this normal route as an extension of his existing visa, he could apply for permanent residency (ILR) once he has been in the UK for 5 years.

Unlikely he will be told to leave.

No, unfortunately not. Benefits cannot be used as income.

What benefits do you claim??

What benefits under universal credit? Have you declared your husband in your benefits forms?

Yes you would need to provide 6 mo this payslips and corresponding bank statements showing the financial requirement of £18,600pa equivalent or £1550 gross per month minimum.

Because child tax credits for example must be claimed in joint names.

Yes you can combine income but it must be for 6 mo this each.
