Who fills in Appendix 2 VAF 4a?

Do I need a solicitor or agency for spouse visa apllication

Hi,

My wife (Thai national) & I have been in a long distance relationship since October 2012 & we got married on 25th May this year in Thailand which was registered at the local district office. My wife lives in Thailand and I live in England

February 2017 she applied for standard visitor visa to come here for up to 6 months but she was refused as they said she didn't supply enough evidence that she had sufficient reason to go back to Thailand (she never mentioned us on her application as she has 2 sisters that already live in UK so used them as the reason to visit her nephews) she re applied a month or 2 later using an immigration agency & got refused again.

We have Facebook messages, iMessages, WhatsApp messages going back to October 2012. I went to Thailand to visit her in April 2014, October 2017 & May 2018. on the last visit my mum & sister came for a holiday with me to attend our wedding so I have evidence & photos from these 3 visits

My salary is above the required amount & I own my own home (have a mortgage)

My wife studied English at university for 2 years in UK on a student visa about 16 years ago & worked as an english tutor in the past (now works as a hotel manager) so I'm confident she will be ok with the English language test.

So my question is; Will be be able to just apply for the visa by ourselves or will it be better to use a solicitor or agency to help with the application.

Whether you choose to pay for legal advice is your choice, but much depends on the quality of advice you are given.

One issue you may have to overcome is that your wife didn't declare she had a husband living in the UK in her visitor visa application. :idea:

Thank you for your reply. Thats what I'm trying to gauge, whether we need to get advice or whether we have a strong / straightforward case & don't need any advice.

We weren't married last February when she applied, we were just long distance boyfriend & girlfriend back then, we only got married in May this year.

Tricky when giving a statement on the length of your relationship to prove your marriage is genuine, if your existence wasn't declared on the visitor visa application, as all information is held on record.

Apart from that issue it appears from your post that your application would be considered straightforward.

Ok, may be an idea to get some advice from a solicitor/visa agency if you think the previous application may pose an issue.

At the time we didn't see the point to mention me as a boyfriend as on the previous application the reason she stated was to visit her family; 2 sisters & nephews (which was the genuine reason) so it was all through one of her sisters that lives here. Her sister wrote a letter on invitation & provided evidence of the address she would be staying at in UK (her sisters house)

My old address on payslips

I'm getting ready to apply for a spouse settlement visa for my wife.

I work for large national company & we don't get payslips sent out in the post to us, if we want to see our payslips we have to log on to our companies work portal to view or print them out.

I moved into my current house in September 2015 & informed my company change of address. Since I moved house I haven't had reason to look at my payslip as I haven't had any money issues & my wages goes straight into my back account every month, However when I printed out my payslips for my wife visa application I noticed they still have my old address on them (my mums house, where she still lives)

For my proof of address / accommodation I have the land registry, deeds to my house, 6 month mortgage statements, 6 months water, gas & electric bill & 6 moths council tax for my current address, that I've lived at nearly 3 years. My banks statements are for my current address to however my payslips have my old address on (mums house, where she still lives)

Will this cause any problems or issues with my application? if so is there a way around it or a way to explain to the home office its genuine oversight on my part?

Based on common sense if payslips are only being used to meet the financial requirement instead any proof of address (cohabitation) purposes then different address on it shouldn't cause any problem.

Thank you for your reply.

The thing I'm worried about is I'm not sure if common sense is applied when dealing with Home office, I've read lots of things of people being refused for silly little things or if things don't match up 100% they don't take time to investigate or ask questions, they just refused.

I've also heard a lot of things about the Home Office themselves making admin errors but ultimately it ends up in the people applying just being refused.

Sounds so easy for them to refuse anything on any small matter, its just another thing thats got me stressing.

pay-slip address should not be an issue and I believe HO won't consider payslip for Cohabitation requirement as long as you have other proofs like water, council, utility etc,.

If you are worried then explain to the home office its genuine oversight on your part that your company system is not updated yet.

P.S: Update your company address now and try re-printing all payslips to see if you get new address on them? just a hint.

In what order to apply?

Hi everyone,

Apologies if these are basic /silly questions.

My wife lives in Thailand & I’m in UK & we are just getting ready to apply for a spouse settlement visa.
I’ve got everything prepared on my side paperwork wise proof of finances & accommodation etc..
We have filled in 95% of her online application on the visa4uk website & she has her IELTS A1 English test boiled on 26th July & her TB tests booked for 6th Aug.

In what order do we need to do things? As in actually finish & apply on the visa4uk website before or after her English & TB tests?

Does she have to go somewhere to register her biometrics? How does she book this?
Also, I’ve printed out an Appendix 2 VAF 4A document & filled it in. Do I have to send that off to Sheffield? Does my wife have to print out Appendix 2 VAF 4A too & submit it somewhere? Or is there an online version she has to do?

Hi,

I'm in UK & my wife is in Thailand. we are currently applying for a spouse settlement visa.

Who fills in Appendix 2 VAF 4a financial requirement form? Just me & then send it to Sheffield or does my wife need to print out a copy too & take it to somewhere in Thailand? Or do we fill it in online somewhere?
