Tier 2 General : Different options to avoid cooling period

Post by rmashett » Thu Jul 26, 2018 11:18 pm

Hello,

Agenda : How to avoid cooling off period ?

Current Visa : Tier 2 ICT (Intra Company Transfer)
Visa Validity : July 2022

Spouse Details:
Current Visa : Spouse Dependent Tier 2 ICT (Intra Company Transfer)
Visa Validity : July 2022

I am in a situation where my employer wants to hire me in UK on General Tier 2 visa but they can't as I need to complete 12 months cooling period i.e.,should be out of UK for 12 months.

Requirement : Now, what are the different options to avoid cooling period and be eligible for ILR and PR

Option 1: My Spouse company applying a General Visa for her? - Not possible , we tried already.

Option 2: My Spouse going for higher study and me become her dependent. Here are my questions around
1. Can I switch directly from Tier 2 ICT to my spouse student dependent visa ?
2. For switching do I need to visit home country ?
3. How long does it take to switch ?
4. How long will my visa be valid as Student dependent ? Is it as long as the Student Spouse visa ?
5. Immediately after switching to my Spouse student visa, can my current employer apply a Tier 2 General visa for me (NO COOLING PERIOD of 12 months)
6. Even on Student dependent visa, should I have to continue for one year to get my employer apply a Tier General visa ?

Option 3: I am open for any options.

Please let me know.
