My husband is a Srilankan nationality came to UK in July, 2010 in student visa. He completed his studies and in 2014 he applied for EEA visa to became his brother's dependent. Still the case is pending in the tribunal. I am Indian nationalality came to UK in 2016 to pursue my MBA degree and in Oct, 2017 we legally married in UK(we had 10 years of relationship before we legally married). Now i switched to Tier-2 General visa and looking for an option to make my husband as my dependent. Is it possible to make him as my dependant in-country itself or he should go back to srilanka and come back?

How did you "legally" marry? At an HO approved Registry office after HO gave approval or.......?

When did his student visa expire??

Yes we got approval from HO and we married in the UK registry office.

You are mistaken. He is an overstayer since his visa expired. Section 3C protection does not extend to applications as an extended family member under the EEA/EU rules. Section 3C only applies to applications under the UK immigration rules.

He has no legal status. It will be difficult for him to apply within the UK as a PBS dependent who has overstayed for 4 years.
