Advise needed please - timing of Application

Post by raf005 » Thu Aug 16, 2018 3:07 pm

Hi there

I am EU citizen (French) and been living and working in the UK for 10 years.

I applied for my permanent residence card by providing my latest 5 P60, which has resulted in me obtaining eligibility as of April 2018. However, my real eligibly was supposed to be 5 years ago.

Now the issue is that I am told that I should wait an additional 1 year (till April 2019) before applying for citizenship ?

Could I still apply for citizenship by providing 6 years or more of P60 ?

Many thanks in advance for your help
Rafic

If you provided your latest P60s, then the Home Office would only have gone by that evidence. If you had worked earlier, why did you not submit the earliest possible P60s?

You can apply for naturalisation after one year of having held PR as per the Home Office records.

If you wish to apply earlier, you will need to get the Home Office to amend their records of when you acquired PR by reapplying for a DCPR based on the evidence that you have of working in the UK for five continuous years, plus evidence that you did not leave the UK for any period of two continuous years after having acquired PR.

Alternatively, reapply for a DCPR along with proof of having worked in the UK for the past 6-7 years. That should move your date of having acquired PR sufficiently for you to be able to apply for British citizenship immediately after getting your new DCPR.

Thanks you secret.simon

I made a mistake during the application. I thought i had access to all my P60 in the online tool of my employer and on the day of my appointment, i realised that i only had the latest 5 years. I didn't have the time to get the earlier ones back then, and I didn't know that the date will have major consequences on my citizenship application.

In the letter that they sent me, they do say that "if you believe that you acquired PR earlier, I can still apply for citizenship by providing additional proofs"
Do you think that is risky ?

you mention that i need to get the home office to amend my date. Do you know what is the exact procedure to do that ?

Many thanks
