ILR on Hold on Tier 2 General Visa from last 3 months

ILR on Hold on Tier 2 General Visa from last 3 months

Dear Experts.

I am very confused please help me. I applied my ILR after 5 years on tier 2 in person about 3 months ago. I have submitted all the required documents and had legal representative with me during application. Unfortunately HO held the decision and I got a letter from Case worker, saying your Application is valid but there are further enquiries that need to be made and your application is passed to a team where these enquiries can be made.

I had a salary increased in feb 2018 from £24000 to £36000 because my working hours were increased from 28 to 36 hours a week. It was not updated in sponsor notes immediately but had been updated in May i.e. after 3 months and only 2 weeks before i put my application in.

In relation to enquiry, we had a compliance visit just 2 weeks after my application and the officer came and interviewed me and my boss and was in office for 2-3 hours and my employer explained to compliance officer that due to more sales generated and to grow more business we need the employee to do more hours so the business can grow further. My Job title is Business Development Manager. Officer took some of the documents confirming the sales has been increased and said he's got everything so far he asked for and advised that results will take 2-3 weeks.

Since then, it's almost 2 and Half months we have not heard anything and my solicitor is saying we cannot chase the HO because before giving the results on your application they will decide on the Sponsor licence.

As the time is passing, It's worrying why HO is taking so long to decide on sponsor licence as we have given the officer everything they asked for.

Please can someone help and throw some light on how long this can take and what outcomes to except.

Waiting for your expert guidance in this worrying times and would like to hear on some experiences like myself.

A salary increase by 12k is significant. Hence the compliance visit. Such a hike will almost automatically raise a red flag. Good that the compliance visit has been done and seem positive. In most cases, if you have passed the compliance visit, the application could be delayed for a further 6 months to 1 year. From the cases reported in this forum, it appears HO will practically wait for the company to pay you the new salary for some time to prove that the hike was not just to meet ILR. Then they will consider the ILR application. Is your company still on the sponsor register?

Company hasn’t heard anything on the compliance visit from the HO yet, it’s been more than 10 weeks since they last visited. Does HO have any time frame to make the decision on the visit?

Company is still on the sponsor list as A rated.

Just to Update My Employer has received a confirmation from Home Office that your Sponsor Licence has been maintained and remain as A Rated sponsor.

Does anybody knows how long it will take for a decision on my ILR?

That’s a great news :) you don’t have to worry now ! It’s a matter of time . To speed up the process you can request HO through your local MP exaolining the situation and enforce to speeding the process to show some emergency of getting your passport back to travel ! You can also write to HO .. as you applied in person so you might have direct email address to contact .

Thanks for your reply.

Already been in touch with my MP last week and they will write to HO. It does take upto 20 working days for HO to respond to MP Enquiries.

Hopefully i will get my ILR soon.

Still No update as of yet and not sure why it's taking this long. No Update from MP yet, already passed 3 weeks since my MP asked HO. Any advise from the experts is much appreciated.

I have one of my friend suggesting to do PAP Application and then HO will respond in a week to 10 days time but as per my understanding PAP Application can only be applied once HO gives you a decision on your application.

Please can you share your valuable thoughts on this and how do i go further from here.

any update regarding your ILR mate?
No update so far on ILR Decision, MP has received a letter saying A review of their records does not show that application is Premium service application and however they confirm the application is consisdered shortly. This was early last week and still no Update. I think HO is using this an excuse to delay the application, how can they not know the application is premium service?

But I have sent the Proff of the Premium service application and now waiting for them to respond.

Do you know normally how long they will take to make the decision now?

I think no one can say how long it may take...i had a visit and they suspend the license! but i applied with a valid active license like you! so if the license revokes than what can we do? can we fight as we applied on time ..we have that right?
